Focal Point - Product
Herbert Packer in his seminal article "Two Models of the Criminal Process" distinguishes between focusing upon process or product. The product clearly can be the controlling of crime, while the process is due process of law. Those who focus on the product of law to determine the effectiveness of law are typically Idealists. It is easy to assume that these people are also conservatives, but it seems equally true that liberals can also focus on the product of law. While the liberal focus may not be crime control; it may be some other desired result that is not dependent on due process.
Some people may believe that we should have laws that require minority quotas in hiring. The reason and the process are secondary and all they desire is the end result to enacted as law, or law enacted that will cause the desired end result.
