Violations
The following are violations of the Student Conduct Code and the range of possible corresponding consequences:
- Abuse or Harassment. Verbal, non-verbal, written or physical abuse of another person. Verbal, written, physical or non-physical action in violation of the Guilford College Harassment Policy and/or Nondiscriminatory Policy. (Level II)
- Aggressive Behavior. Any conduct which involves or interferes with the person of another including, but not limited to, fighting, physical assault, unlawful detention, interference with another's freedom of movement, pushing or shoving, or threats to do physical harm. (Level III)
- Alcohol. The following constitute violations of the college's alcohol policy. If the student is under twenty-one years of age or there is a medical or safety concern all alcohol will be properly disposed of at that time. If multiple violations (3 or more) are committed by a student during a given academic year, Level I violations may warrant level two or three sanctions.
- Empty alcohol containers (bottles/cans) are prohibited in a room where both residents are under the legal drinking age. The displaying or possession of such containers is a violation of the Student Conduct Code. (Level I)
- Age limitations. The laws of the State of North Carolina pertaining to the possession and use of alcoholic beverages shall be followed specifically. It is illegal for persons under the age of 21 to consume or possess alcohol. It is also illegal for persons under or over 21 to supply alcohol to a student who has not reached the age of 21. The laws of North Carolina will apply to all students and visitors of Guilford College. (Level I)
- Closed containers. The transportation of closed containers of alcohol by students of legal drinking age is not prohibited. All closed containers must be transported in a bag or other concealing device. (A closed container is one on which the seal has not been broken.) (Level I)
- Public display of alcoholic beverages on campus or college-owned property. Alcoholic beverages may not be possessed or consumed by persons of any age outside of individual residence hall rooms, except for the north apartment's balconies and steps, or alternative house porches. Alcohol will be permitted in the Student Community Center pursuant to the Campus Alcohol Policy. Consumption or possession of alcohol is prohibited in all public areas, such as hallways, basements, bathrooms, lounges, campus grounds, and in administrative or classroom buildings. (Level I)
- Purchase of alcohol with college funds. Neither the college nor any group, which owes its existence to Guilford, whether officially or unofficially, formally or informally, will be permitted to use any organizational funds derived from or held by the institution for the purchase of any kind of alcoholic beverage. (Level I)
- Abusive Use of Alcohol/Misconduct Under the Influence of Alcohol. Unbecoming behavior or any conduct violation (either on or off campus) committed by a student under the influence of alcohol is not acceptable in the Guilford community. Abusive use of alcohol will be considered if the use of alcohol by a student leads to medical consequences, police reports or inappropriate behavior. (Level II)
- Beer kegs, and other common containers of alcohol (including beer "bongs" and funnels) are not permitted on campus or at college-sponsored events off-campus. (Level II)
- Off-Campus violations. Although Guilford cannot and does not accept responsibility for the conduct of students while they are off college property and cannot regulate the sale of alcoholic beverages to members of the Guilford community by the management of off-campus businesses, the college reserves the right to make off-campus conduct by its students matters of student discipline under the Student Conduct Code.
- Contempt of the Judicial System. Full cooperation with judicial investigations, hearings and sanctions is required. Therefore, it is a violation for any Guilford student to do any of the following: (1) Disrupt student judicial proceedings; (2) Fail to perform obligations imposed pursuant to the Student Conduct Code; (3) Fail to appear at a judicial meeting or hearing when requested to do so by the Office for Campus Life (failure to appear at a judicial meeting or hearing may result in an additional $50 fine or your case(s) may be decided in your absence); (4) Fail to complete judicial sanctions by given deadlines. (Level III)
- Disruptive Conduct. No student shall engage in behavior that disrupts the academic, social, or residential pursuits of members of the college community. No student shall engage in behavior that poses a direct threat to the health or safety of self or others. (Level III)
- Disorderly Assembly. Guilford, as an academic institution, is committed to free and open inquiry into matters of social, political and economic concern permits and encourages the presentation of all views and dissent by orderly means. A group will not be allowed to assemble if that group's conduct is riotous and/or impedes the normal operations of the college as determined by the president or the appropriate administrative officials. (Level I)
- Drugs. The college does not tolerate and strictly prohibits the possession, use, and/or distribution of illegal drugs, drug paraphernalia (purchased or homemade), or other controlled substances by any member of the Guilford community. Examples of prohibited and illegal items include, but are not limited to, any amount of an illicit drug (including seeds), bongs, pot pipes (bowls), scales (electronic or hand-held), blow tubes, etc. Further, substances which appear to be illegal or controlled (by virtue of sight, smell, and other contextual factors) will be treated as such and are prohibited under this policy. The college reserves the right to notify appropriate authorities involving any violation of local, state, or federal law. First Offense -- Level II (if first offense involves the selling, making and/or distributing of illegal drugs or other controlled substances -- Level III); Second Offense -- Level III.
- Endangering Health and/or Safety. No student shall engage in behavior that poses a direct threat to the health or safety of self or others. Behaviors which create a risk of danger to oneself or others in the college community are prohibited and specifically include, but are not limited to, propping residence hall doors open, tampering with residence hall access system, and/or throwing objects from or hanging from windows or balconies. (Level III)
- Failure to Comply. Students are required to comply with the reasonable request of college officials or agents of the college in the performance of their duties, specifically including, but not limited to, Campus Life (including resident advisers and hall directors) and Public Safety staff members. (Level II)
- Falsification of Information. In an effort to uphold the abiding principles of honesty and integrity, Guilford strictly forbids falsification of information reported on college forms and records or to college officials. Such falsification might include, but is not limited to, forged signatures and inaccurate information on course registration materials, an admissions application, work-study forms, college records or student ID card documentation. Misrepresenting oneself or others through the use of college property or resources (including e-mail, the Internet, telephone or verbally) is also considered a violation. (Level II)
- Fire Safety. Regulations must be strictly observed to protect the health and safety of members of the Guilford community. Any violation of this fire safety code must, by law, be reported to the Greensboro Fire Department for possible prosecution of the perpetrator(s)under North Carolina General Statute 14-286. Failure to report a violation will result in a college judicial charge. The following are prohibited with regards to fire safety:
- Accidental Fires. Accidentally or negligently starting a fire.
- Alarms. Falsely setting off any fire alarm on campus whether intentional or unintentional.
- Failure to Leave a Building During a Fire Alarm. Failing to leave a building, even if a student believes the alarm to be false or a drill.
- Setting of Fires. Setting of fires and actions that may contribute to creating a fire.
- Tampering with Equipment. Any tampering with fire safety equipment including, but not limited to, alarm bells and pull boxes, fire extinguishers and smoke detectors.
The North Carolina General Statute Section 14-286 states as follows: "It shall be unlawful for any person or persons to wantonly and willfully give or cause to be given, or to advise, counsel or aid and abet anyone in giving, a false alarm of fire or to break the glass key protector, or to pull the slide, arm or level of any station or signal box of any fire-alarm system, except in the case of fire or willfully misuse or damage a portable fire extinguisher or in any way to willfully interfere with, damage, deface, molest or injure any part of portion of any fire-alarm, fire-detection, smoke-detection or fire-extinguishing system. Any person violating any of the provision of this section shall be guilty of a misdemeanor punishable by a fine not to exceed five hundred dollars, imprisonment for not more than six months or both." (Level III)
- Hate Crime - a "crime in which the defendant intentionally selects a victim, or in the case of a property crime, the property that is the object of the crime, because of the actual or perceived race, color, national origin, ethnicity, gender, disability, or sexual orientation of any person." (Section 280003(a) of the Violent Crime Control and Law Enforcement Act of 1994 28 U.S.C. 994 note). With respect to the Guilford College Student Code of Conduct, a Hate Crime is a modifier of some other violation of the Student Code of Conduct (Level III).
- Hazing. Under North Carolina law, it is unlawful for any student in any college or school to engage in hazing or to aid or abet any other student in the commission of the offense. Hazing is defined as follows: "to subject another student to physical injury as part of an initiation, or as a prerequisite to membership, into any organized school group, including any society, athletic team, fraternity or sorority, or other similar group." Any violation of this section shall constitute a Class 2 misdemeanor North Carolina General Statute 14-35 is a Class 2 misdemeanor. (Level II)
- Host Responsibility. Guilford students are responsible for their guests. Students will be charged judicially with any violations committed by non-Guilford student guests, and students will be charged with host responsibility for violations committed by Guilford student guests. (Level II)
- Littering. The public disposal of any substance or item in an area other than a trash receptacle is prohibited. (Level I)
- Local, State, or Federal Laws. Any violation of local, state or federal law may also be a violation of college policy. The college reserves the right to report any such violation to the appropriate authorities. The college also reserves the right to make off-campus conduct by its students matters of student discipline under the Student Conduct Code. (Level III)
- Misuse or Tampering With Emergency Equipment. The misuse, tampering, unauthorized or unnecessary use of emergency equipment, and damage resulting from such use, limits or interferes with the college's ability to respond to actual emergencies. Misuse and unnecessary or unauthorized use of such equipment, and any damage resulting from such use, is prohibited. Emergency equipment includes, but is not limited to: the 2911 campus emergency number, the emergency "Code Blue" telephones, whistles, college vehicles and their contents, specifically the Public Safety vehicles, golf carts, bicycles and any other public safety equipment and college/Public Safety communications equipment. (Level III)
- Misuse of Student Identification. Guilford ID cards may not be used for fraudulent purposes. The following demonstrates typical improper uses of student identification: (Level I)
- Privileges obtained from ID cards are not transferable.
- Gaining access to the college facilities and/or activities by use of another student's ID card or by the fraudulent use of an ID card is prohibited. All parties are held accountable, assuming they had knowledge of the improper use.
- Loaning one's card to another for any purpose or obtaining additional cards under false pretense is prohibited.
- Students are required to carry their student ID cards at all times. Students are required to show their ID card and give correct identifying information when requested by a college official or an agent of the college in the performance of their duties. This includes, but is not limited to, Campus Life and Public Safety staff members
- Noise. To cause noise on campus grounds or in any college building, which disrupts an atmosphere conducive to work, study and rest is prohibited. (Level I)
- Other College Policies. Failure to abide by Guilford policies as outlined in the Guilford College Student Handbook. (Level II)
- Property Damage. Damage to another's belongings or to college property (beyond that incurred through normal use) is prohibited. (Level III)
- Residence Hall Policies and Procedures. Failure to abide by the Residence Hall Procedures, which are outlined in the Guilford College Student Handbook. (Level I)
- Sexual Misconduct (Please refer to the SEXUAL MISCONDUCT PROTOCOL for more information and definitions). Forms of sexual misconduct:
- Level I
- Non-Consensual Sexual Contact: Any sexual touching (including disrobing and exposure), however slight, with any body part or any object, by a man or a woman upon a man or a woman, without effective consent.
- Sexual Harassment: Federal and state law prohibit sexual or other discriminatory harassment. Sexual harassment of job applicants, employees or students at Guilford is defined as unwelcome sexual advances, requests for sexual favors or other physical or verbal conduct of a sexual nature. Please see Sexual Harassment Policy and Procedure as outlined in the Guilford College Student Handbook.
- Level II
- Sexual Exploitation: When a student takes non-consensual, unjust or abusive sexual advantage of another, for his/her own advantage or benefit; or to benefit or advantage anyone other than the one being exploited; and that behavior does to other wise constitute rape, sexual assault or sexual harassment. Examples include:
- inducing incapacitation with the intent to rape or sexually assault another student,
- non-consensual video, audio taping or still photography of sexual activity,
- allowing others to observe a personal act of consensual sex without knowledge or consent of the partner,
- engaging in voyeurism (Peeping Tom),
- Sexual Exploitation: When a student takes non-consensual, unjust or abusive sexual advantage of another, for his/her own advantage or benefit; or to benefit or advantage anyone other than the one being exploited; and that behavior does to other wise constitute rape, sexual assault or sexual harassment. Examples include:
- Level III
- Non-consensual Sexual Intercourse: Any sexual intercourse (anal, oral, or vaginal), however slight, with any body part or any object, by a man or a woman upon a man or a woman, without effective consent.
- Knowingly transmitting an STD or HIV to another student.
- Engaging in prostitution or promoting prostitution (i.e. personally gaining money, privilege, or power from the sexual activities of another student)
- Level I
- Theft. Theft of property is prohibited and considered intolerable. Note: The college is not liable for any theft or loss due to fire, water, etc., in campus buildings either during the semester or during the vacation periods. Students are urged to carry insurance coverage on their personal property through their parent's homeowner's policies or purchase their own policy. Students should lock their rooms and carry their keys. Large sums of money should not be kept in student rooms. Any student who has lost property should contact the Office of Public Safety immediately. (Level III)
- Unauthorized Entry, Use, Or Possession. Unauthorized entry, use or possession of college and/or personal property is prohibited. This includes, but is not limited to, unauthorized use, possession or duplication of college keys and unauthorized entry into or use of college facilities. (Level III)
- Buildings. Entry into public buildings after regular closing hours without permission of college authorities is prohibited. Students are not permitted on the rooftops of buildings for any reason. Violators may be subject to judicial charges and will be billed the actual repair cost for any damage.
- Offices. Entry into any faculty or staff office at any time without permission of that faculty or staff member is prohibited. Students are prohibited from using college telephones and office equipment without prior permission.
- Weapons and Fireworks. Neither violence nor weapons (including but not limited to firearms, BB guns, paintball guns, pellet guns, or knives with blades over 4 inches that are not cooking utensils) that support violence are tolerated at Guilford. Furthermore, North Carolina law prohibits the possession of weapons, concealed or otherwise, on private or public campuses. The only exception would be for "a weapon used solely for educational or school-sanctioned ceremonial purposes or used in a school-approved program conducted under the supervision of an adult whose supervision has been approved by the school authority" (North Carolina General Statute Section 14-269.2). In addition, the possession, storage or use of any instrument, device or substances that intentionally or recklessly creates a reasonable apprehension of imminent bodily harm to the person or property of another on college or college-related premises is strictly prohibited. This policy does not apply to sworn police officers that may be on campus either to attend classes or to complement on-campus security staff for special events and emergency calls. Lastly, the possession and or use of fireworks is strictly prohibited in accordance with state law. (Level III)
